Sell to Us Terms

These Sell to Us Terms (the "Buylist Terms") apply whenever you offer to sell or trade cards, sealed product, or collections to Break Boss Cards and Collectibles LLC ("Break Boss," "we," "us"), whether through the Sell to Us form, by email, on a stream, or at the counter. They are part of the Break Boss Terms of Service. By submitting items to us you agree to these Buylist Terms.

1. Who can sell to us

  • You must be 18 or older. We do not buy from minors, even with a parent present, unless the parent is the seller of record.
  • A valid government-issued photo ID is required for every trade-in, in person or by mail. In the shop we check it at the counter. For mailed items, send us a photo of your ID by email before you ship. We record the information the law requires us to keep, may photograph or copy the ID, and refuse any purchase where ID is not provided.
  • We may decline to buy anything, from anyone, for any lawful reason, including because we cannot authenticate it, do not need it, or are not comfortable with where it came from.

2. Your promises about the items

By offering an item to us you represent and warrant that:

  • you own it outright and have the full right to sell it;
  • it is not stolen, lost, borrowed, on consignment, subject to a loan or lien, or part of an estate you do not have authority over;
  • it is authentic and, to your knowledge, has not been altered, trimmed, recolored, resealed, re-wrapped, cleaned with chemicals, or tampered with, and graded holders are genuine and uncracked;
  • the information you gave us about it, including condition, is true and complete; and
  • you are not acting for anyone else unless you tell us and show authority.

If any of these turns out to be false, you agree to refund what we paid you, plus any loss we suffer, and we may take legal action. We cooperate with law enforcement and will report suspected stolen or counterfeit property.

3. Quotes and offers

  • Quotes given from photos, lists, or descriptions are estimates. The final offer is made after we inspect the items in hand.
  • A written offer is good for 7 days from the date we send it, unless it says otherwise. Card prices move, so an expired offer may be re-quoted higher or lower.
  • Offers are based on current market comparables, condition, demand, and our inventory needs. We explain how we got to the number if you ask. You are free to decline.
  • Trade credit offers are higher than cash offers. Trade credit is store credit under the Terms of Service: no cash value, not transferable, usable only at Break Boss, and does not expire.

4. Sending items to us

  • Do not ship anything until we have sent you a written offer and a shipping instruction. Unsolicited packages may be refused or returned at your cost.
  • Pack cards in sleeves and toploaders or card savers inside a rigid box, and sealed product in a box with padding on all sides. Ship with tracking and insurance. Items are your responsibility until we sign for them. We are not liable for packages lost or damaged on the way to us.
  • Include your name, email, phone, and the offer number in the package.

5. Inspection and adjusted offers

  • We inspect every item within 3 business days of receipt. Inspection may include comparing to the photos you sent, checking for alterations and reprints, verifying grading certification numbers, and weighing or examining sealed product for tampering.
  • If items match your description, we pay the offered amount.
  • If items differ from your description, are missing, are altered, are not authentic, or show tampering, we will send you an adjusted offer with an explanation. You may accept it or ask for the items back. If you do not respond within 7 days of the adjusted offer, we will pay the adjusted amount and the sale is complete.
  • Items you decline to sell after inspection are returned to you at your expense by tracked mail, or you may pick them up at the shop. Items we believe are counterfeit or stolen are not returned; they are held for law enforcement.

6. Payment

  • In-person sales are paid on the spot in cash, store credit, or another method we agree to. Mailed-in sales are paid within 3 business days after inspection by the method we agreed to.
  • Cash purchases above the reporting thresholds set by federal law will be reported as required. We may require additional identification for large transactions.
  • You are responsible for any taxes owed on money we pay you.

7. Title and finality

Ownership of the items passes to Break Boss when we pay you. Once paid, the sale is final. You cannot buy an item back at the price we paid, and we may sell it at any price. If you sold something by mistake, tell us immediately and we will try to help, but we are not obligated to reverse a completed sale.

8. Estates, collections, and appraisals

We buy full collections and estate lots. For estates we may ask for proof of authority, such as letters testamentary. Any value we state during a collection review is a purchase offer, not a formal appraisal, and should not be relied on for insurance, tax, probate, or legal purposes.

9. Limits on our liability

To the extent the law allows, our total liability to you for any claim relating to a buylist transaction is limited to the amount we agreed to pay you for the items in question. We are not liable for market movements between quote and payment, for the value of items lost in transit to us, or for indirect or consequential losses.
