Live Break and Auction Rules

These Live Break and Auction Rules (the "Rules") are part of the Break Boss Terms of Service. They apply to every break and auction we run, whether on TikTok LIVE, Whatnot, eBay Live, breakboss.com, in the shop, or anywhere else. By buying a spot or placing a bid you agree to these Rules. 1. What a break is, and what you are buying
- A "break" is a live event where Break Boss opens factory sealed trading card product on camera and distributes the cards to the people who bought spots, using the format announced before the break starts.
- When you buy a spot, you are buying physical trading cards: every card that falls to your spot under the announced format. You own those cards the moment they are assigned to your spot on stream. What you are paying for is those cards plus our service of opening, sorting, sleeving, and shipping them.
- Every spot receives the cards assigned to it. The number, condition, and market value of those cards depends on the product and on which cards happen to be in the packs. You may receive cards worth less than you paid for the spot, and you may receive no "hit" or autograph at all. Break Boss does not promise any particular card, number of cards, or value.
- Nothing about a break is a lottery, raffle, sweepstakes, or game of chance operated by Break Boss. You are buying a defined share of the contents of a defined product. If you are unsure whether buying a spot is permitted where you live, do not buy one. You are responsible for compliance with your local law.
2. Break formats
We announce the format, the product, the price per spot, and the number of spots before the break. Common formats:
- Pick Your Team (PYT): you choose a specific team. You receive every card of that team from the product. Team prices vary.
- Random Team: all teams are assigned to spots at random after spots are sold, using a randomizer run on camera.
- Division or Conference: you receive every team in the announced group.
- Pick Your Player or Random Player: like team breaks, but by player, for products that are organized that way.
- Serial or Hit Draft: spots are randomized into a draft order and pick hits in that order, as announced.
- Personal break: you buy an entire box or case, we open it live, and you receive everything.
We may run other formats. The format announced on stream at the time spots are sold is the one that applies.
3. Team lists, multi-team cards, and "no team" cards
- Team assignments follow the manufacturer's checklist. A player goes to the team printed on the card. If the checklist and the card disagree, the card controls.
- Cards showing more than one team go to the spot that owns the team of the first player listed, unless we announce a different rule for that product before the break.
- Cards with no team, such as league logo, mascot, retired-league, draft-pick, or "no team" cards, go to the spot announced for that product, or, if none was announced, are randomized among all paid spots on camera.
- Relocated, renamed, or defunct teams belong to the current team that carries the franchise, unless the checklist lists them separately.
- Our on-stream call on a team assignment is final. If we make a sorting mistake, tell us within 7 days of delivery and we will correct it if the card is still in our possession or the other customer agrees to return it. We are not responsible for a card that has already shipped to another customer.
4. Randomization
- Team assignments are drawn on camera using a randomizer tool or a physical card draw or flip. The method can vary by platform (TikTok, Whatnot, eBay Live, and others) and is announced before the draw. The result shown on stream is final.
- Once teams are drawn, assignments change only through a trade that both spot holders agree to and confirm with us on stream or by message before the product is opened. We are not a party to that trade and do not broker or enforce it.
- Every live break and every draw is recorded and archived on our YouTube channel for verification. If you believe a draw was done incorrectly, tell us before the product is opened.
5. Buying a spot, filling, and cancellations
- Payment is due immediately when you claim a spot. For random team breaks, payment must be received before teams are drawn. For pack and box breaks, payment must be received before the pack or box is opened. Claiming a spot in chat without paying does not reserve it. An unpaid spot is voided or relisted, and repeated non-payment gets you restricted from future breaks and auctions.
- A break runs when it is full or when we decide to open it anyway. If a break does not fill within a reasonable time, we may combine it with another break, run it with the remaining spots covered by Break Boss (the house keeps those spots' cards), reduce the product, or cancel it and refund every paid spot in full.
- We may cancel or postpone any break for any reason before it opens, including product not arriving, damaged product, stream problems, or staffing. If we cancel, you get a full refund to your original payment method, or, if you prefer, credit toward another break.
- Once the first pack is opened, every spot in that break is final. There are no refunds, exchanges, or credits because of the cards you received, because you missed the stream, because you changed your mind, or because the value of the cards is lower than you hoped.
- Before the first pack is opened, you may ask to cancel a spot by messaging us. We will refund it if we can fill the spot or if the break is far enough out that cancellation does not affect it. Refunds for cancellations you request may be issued as store credit.
- You do not need to watch live. Cards assigned to your spot are yours whether or not you watch.
- Spots cannot be transferred or resold to someone else. We ship to the person and address on the order. If you want to gift a spot, buy it with the recipient's shipping address. The one exception is a team trade between two paid spot holders under Section 4.
- If we lower the price of remaining spots, offer a fill discount, or add a bonus to get a break filled, earlier buyers are not entitled to a refund of the difference or to the bonus, unless we announce otherwise.
- Owners, employees, and household members of Break Boss do not hold spots in random breaks. Where the house covers unsold spots to run a break, we announce it before the randomizer runs.
6. Damaged, defective, and missing cards from the manufacturer
- We open product exactly as it comes from the manufacturer or distributor. Cards that come out of the pack damaged, dinged, scratched, miscut, off-center, printed wrong, or with surface issues are manufacturer defects. We will show them on camera when we notice them, but we do not refund, replace, or credit for them.
- If a box or case is short packs, short hits, or contains a wrong or duplicated card, that is also a manufacturer issue. We will help you contact the manufacturer, and we will provide the stream recording as evidence if you ask.
- Redemption cards are handed to the spot they fall to. You redeem them directly with the manufacturer. We are not responsible for what the manufacturer sends, how long it takes, or whether it ever arrives.
7. Card handling, base cards, and what ships
- We sleeve and toploader hits, numbered cards, autographs, memorabilia cards, rookies, and inserts. We handle every card carefully, but sorting and sleeving on camera can leave minor handling marks on raw cards, and we are not responsible for those.
- Base cards ship by default. If you do not want your base cards, you must decline them live during the break, out loud or in chat, before the break ends. Base cards are not held, refunded, or credited after the fact if you did not decline them during the stream.
- Cards from a break ship together in one package. We do not ship individual cards separately unless you ask and pay any additional shipping.
8. Shipping, holds, and unclaimed cards
- Break cards ship within 24 hours after the break ends, to the shipping address on your order or platform account. Tracked shipping is free on hits worth $50 or more from a single break. Otherwise shipping is charged as shown in the Shipping Policy.
- You may ask us to hold your cards and combine them with future breaks. Held cards ship automatically 30 days after the first hold, whether or not more cards have been added, and we charge one shipping fee.
- Cards that are not claimed within 30 days of the break become the property of Break Boss and go back into inventory. "Claimed" means you requested shipping, or picked up in store. We send a courtesy reminder before that happens, but it is your responsibility to request shipping within the 30 days. No refund is owed for unclaimed cards.
- Local pickup is welcome. Pickup cards are held for 30 days under the same rule.
9. Live auctions
- We run auctions on TikTok LIVE, Whatnot, eBay Live, and other platforms. Where the platform runs the bidding and payment, its auction rules control. Where we take bids in chat, these rules apply.
- We show the card, name a starting bid, and take bids in the comments. The highest bid at the moment we close the lot wins. Our call on the winner, the winning amount, and whether a bid was placed in time is final.
- A bid is a binding offer to buy. If you win, payment of the winning bid plus shipping and any tax is due immediately, through the platform's checkout or the invoice link we send. We do not add a buyer's premium.
- If payment is not received immediately, we may void the sale, relist the item, offer it to the next highest bidder, and restrict you from future auctions and breaks. Repeated non-payment is a breach of the Terms of Service.
- Bid retractions are not accepted.
- Won cards ship sleeved and tracked within 24 hours of payment, with insurance on graded cards.
- Owners, employees, and family members of Break Boss do not bid in our auctions.
10. Stream conduct
- We remove and block anyone who harasses others, spams, scams, pretends to be staff, tries to sell in our chat, or interferes with a break or auction.
- Break Boss is not a party to, and does not enforce, trades, side deals, or wagers between viewers.
- Streams are recorded. Your chat messages, username, and any audio or video you contribute may appear in replays, clips, and marketing.
- If the stream drops, freezes, or the platform goes down during a break, the break continues off camera only if the product is already open, and we post the full recording or a fresh video of the remaining packs as soon as we can. If the product has not been opened when the stream fails, we pause and resume on camera. A technical failure is not grounds for a refund of a spot that was assigned on camera.
- Break and auction recordings are archived on our YouTube channel. Point us to the break date if you need footage for a claim.
11. Platform rules
Every platform we stream on has its own rules, fees, payment system, and buyer protection. Those rules apply in addition to these. When a platform's buyer protection requires a different outcome than these Rules for a particular sale, the platform's requirement controls for that sale only.
12. Chargebacks
A chargeback on a spot in a break that was opened as announced, or on a won auction that was shipped as described, is a breach of the Terms of Service. See Section 7 of the Terms of Service. We keep stream recordings and will use them. We may restrict or ban any customer from future purchases, auctions, and breaks, at our sole discretion, for repeated non-payment, chargeback abuse, or any conduct that disrupts our ability to run live sales fairly for everyone else.
13. Our discretion
We may change formats, pricing, and rules for future breaks at any time, and may make reasonable on-stream decisions to resolve situations these Rules do not cover. When we make a call on stream, that call is final for that break.
14. Responsible participation
Breaks are entertainment and a way to collect, not a way to make money. Set a budget before the stream and stay inside it. If you want us to stop selling you spots, email break_boss@outlook.com from the email on your account, or message us from the platform account you buy with, and we will block that account from break purchases for the period you ask for, with a minimum of 30 days. We will not lift a block early, even if you ask.
